DIRECTOR OF COMPLIANCE\u00a0<\/b><\/p>\n

The Fair Competition Commission is an independent Government Body established under the Fair Competition Act, 2003 (No. 8 of 2003) to promote and protect effective competition in trade and commerce and to protect consumer from unfair and misleading market conduct. The ultimate goal of the Act is to increase efficiency in the production, distribution and supply of goods and services.<\/p>\n

The Fair Competition Commission (FCC) invites Public Servants to submit their applications to fill the post identified below: \u2013<\/p>\n

DIRECTOR OF COMPLIANCE\u00a0\u00a0<\/b>FCC\/DC\/ 01\/2020<\/p>\n

Reports to: Director General<\/p>\n

Supervises:<\/b><\/p>\n

Head of Investigation,
\nHead of Enforcement; and
\nHead of Consumer Protection.<\/p>\n

Qualifications for the Post:<\/b><\/p>\n

Holder of Master\u2019s Degree in the field of Law from any recognized university, with at least 10 years experience in the field of Law and should be an Advocate of the High Court. Possession of computer knowledge is an added advantage.<\/p>\n

Other requirements<\/b><\/p>\n

Be able to perform the functions and duties competently and honestly;
\nDemonstrate a high standard of professional competence and managerial ability.<\/p>\n

Key Duties and Responsibilities;<\/b><\/p>\n

In particular, the Director will have responsibility for:<\/p>\n

Advising the Director General on matters related to investigation, enforcement; and consumer protection;<\/p>\n

<\/div>\n

Reviewing all complaints filed with the Commission (other than consumer complaints) and advise the Commission on appropriate course of action;
\nEnsuring that investigations are adequately carried out on alleged violations of the FCA;
\nDeciding whether cases that have been considered by the Investigation Department require further action;
\nEnsuring that cases are presented to the Commission with appropriate recommendations;
\nConvening case hearing meetings of the Commission and ensuring proper recording of the proceedings in audio and written forms;
\nPreparing enforcement orders to ensure compliance with the FCA as directed by the Commission;
\nMonitoring compliance with enforcement orders and recommend appropriate action relating to any violations of the orders to the Commission;
\nRepresenting the Commission in appeals filed in the Fair Competition Tribunal, the High Court or the Court of Appeal;
\nAdvising the Director General on product recalls;
\nMaintaining a Public Register as provided under Section 77 of FCA;
\nEnsuring that the Commission\u2019s obligations in respect to consumer protection are carried out;
\nPreparing annual, monthly and weekly work plans for the Division as a whole and to each staff member in the Division;
\nEnsuring efficient allocation of resources in the Division;
\nMonitoring the performance of the directorate against agreed performance targets.
\nPerforming any other duties as assigned by the Director General from time to time.<\/p>\n

Salary Scale<\/b>\u00a0\u2013 FCCGSS 12<\/p>\n

MODE OF APPLICATION<\/b><\/p>\n

Application letter supported by curriculum vitae, academic certificates and testimonials should be submitted to the Fair Competition Commission through their current employers;
\nEach application letter should quote the reference number of the post applied for;
\nCandidates must be employed in the public service on permanent and pensionable terms.<\/p>\n

NB:\u00a0 Applicants should take note that, according to the Fair Competition Act, No. 8 of 2003, the final selection will be based on competitive process. The shortlisted candidates will therefore be subjected to a series of formal interviews before the final selection is made. The selected Public Servants will have to follow all necessary TRANSFER processes according to laws Governing Public Service.<\/p>\n
